私もアサヒビールのロゴ裁判にて{{TOO-Japan}}および{{PD-textlogo}}の適用下である可能性を考えましたが、元の著作物から装飾を除去し、創作の閾値をあえて下げてフォントだけにしたものが二次的著作物の範疇になるかどうか、あえて削除議論にて問うたものです。第三者の意見を待ちましょう。

At the Asahi Breweries (Holdings) logo trial, I also considered the possibility that {{TOO-Japan}} and {{PD-textlogo}} were applied, but I deliberately asked in the deletion discussion whether removing decorations from the original work and deliberately lowering the creative threshold to only fonts would fall under the category of derivative works. Delete Not sourced in the FUR (it's from here), but a logo for a two-day transitional format having any permanence outside a few social media posts is pretty questionable. We've got seven days to determine the latter so we'll know Tuesday morning for sure, but this should be a Wikipedia-hosted image rather than on Commons due to the likely copyrighted skyline design. Despite the uploader's assertions, these images relating to the Mr. Six mascot that has been used by various iterations of the Six Flags theme park chain, which appear to come from Six Flags advertisements, are highly unlikely to be either CC-licensed "own works" or in the public domain. The uploader has removed copyvio tags, so a discussion (even of the "going through the motions" type) seems necessitated.

Keep. Certainly not CC BY SA as this file page claims, but we should take what Wikipedia's files say with a grain of salt. They often take the "quick, safe route" with their images and don't check for the possibility of PD status, and for w:File:Discord_logo.svg there's no detailed case for it not passing the threshold of originality. They just used their default fair use template; not much of a case at all.

Looking at the examples at Commons:Copyright_rules_by_territory/United_States#Threshold_of_originality, this seems to be right on the border of what would be acceptable. Compare File:American Owned American Made Logo.jpg with simple curves, File:Geek Squad logo.svg with simple curves, File:Nikken logo and wordmark.svg with simple curves, File:Los Angeles Football Club.svg with specific angles of lines. All of those were tossed out of court.

The Discord logo is a collection of very simple shapes, with one color, and one of the shapes happens to have a few curves. I'm willing to be proven wrong, but I think it passes. SnowyCinema (talk) 21:59, 12 September 2024 (UTC)[reply]

This file is a screenshot from a video under copyright by Colorado Storm chasers, an LLC registered in Cascade, CO.[4]

They posted the video to their Facebook page[5] and their Twitter stream[6] and this screenshot appears to come from around the 0:10 mark.

It was filmed in the United States in 2021.

There is no claim that the anonymous Colorado Storm Chasers videographer was a US Federal government employee performing their duties, or that this image is ineligible for copyright for any other reason.

As an video made in the United States after 1989, copyright came into being as soon as the video was made. Individual frames from a video under copyright are also under copyright.

This image was uploaded to Commons under rationales expressed in the {{PD-NWS}} template at the time; that

when the weather.gov general disclaimer says that material not in the public domain will be specifically noted, it means that it must be published with a formal copyright notice. Whereas in reality, not only has the NWS never promised any specific form of notation, there is ample evidence to demonstrate this is not their general practice. This belief also chooses to ignore the words elsewhere in the disclaimer that state that third party images are used by the NWS under license, and to contact the third-party creators for re-use.
the words of a NWS Sioux City regional office policy that placed some public submissions in the public domain somehow applied to this image, although there is nothing to connect it with that office. (The still was published by the Grand Junction office).

Delete – Although aspects of the image are in the PD (made by U.S. government employees as confirmed via the image caption), aspects of it are not PD, including the tornado tracks, which were modified by the authors. A check of the paper also indicate the project was funded by the w:National Science Foundation, not NOAA. If it was NOAA, that would be a different story as it would be PD as part of the NOAA Library Repository. I also checked the NOAA Library Repository and it is not listed. This photo was taken by Tim Marshall in the United States in 2023, and was included by the NWS in a presentation published to arcgis.com.[7]

There is no claim that Marshall was a US federal government employee performing his duties, or that this image is ineligible for copyright for any other reason.

As a photo taken in the United States after 1989, copyright came into being as soon as it was taken.

This image was uploaded to Commons under rationales expressed in the {{PD-NWS}} template at the time; that

the general disclaimer for the weather.gov website advises that some of the content there is in the public domain
some images submitted to the NWS Sioux City regional office by members of the public are in the public domain

This image was not published on weather.gov, and there is nothing to connect it to the NWS Sioux City regional office, so neither of these rationales apply to this image.

Without any evidence of permission that the photographer released this image into the public domain or under a free license, it is apparently unfree. Rlandmann (talk) 03:17, 2 September 2024 (UTC)[reply]
