Australian Aboriginal flags
[edit]This is an old issue but on going issue it seems. The Australia Aboriginal flag is copyrighted in Australia, it can't be uploaded under a free use license and therefore cannot be uploaded onto Commons. See the undeletion request for File:Aboriginal Flag 02.jpg, AIATSIS, NAIDOC and Minding Culture: Case Studies on Intellectual Property and Traditional Cultural Expressions.

Comment Is this even the Australia Aboriginal flag? It can be anything. I can't see the link between a french scientist and scifi writer and this flag. @Esby and Asclepias: who respectively imported the files and added this cat. Cdlt, VIGNERON (talk) 13:09, 3 August 2017 (UTC)
- The shirt has the Australian Aboriginal flag design (it doesn't have to be in a flag form, as it is an artistic work) which is copyrighted in Australia (a decision made by the High Court of Australia), even Google had to remove it from a Doodle back in 2010. I added these as I felt that de minimis was borderline. Interestingly just to show you how restrictive Australia is with its copyright see T-shirts & copyright by the Australian Copyright Council. - I assume this is just a tshirt with some protected content, this does not make the image not hostable on commons, especially when the subject is obviously the guy wearing the tshirt... Esby (talk) 19:23, 3 August 2017 (UTC)

- Bidgee your point is valid only if this is indeed the aboriginal flag on this shirt, which seems a bit of a stretch. As the design is very simple, it could be anything, a familly flag for example (I didn't find a crest with the same design but « Party per fess sable and gules with a bezant » is not impossible, the closest I find is the en:Streatfeild family). No free license, while it may seem "simple" under Australian law it is copyrightable (just like the Aboriginal flag)

These files are dubious, first time I've seen them. These are out of scope since they have no source for their factual existence and if they were, possibly copyrighted like the Aboriginal flag
